1. Scope, operator and acceptance
These Terms of Service govern the use of ONIRust services: our website (onicup.com), the Rust tournaments we organise and the game server they are played on, our Discord community, the store, digital products, and related services.
ONIRust is operated by Onur Can Hira, Ulm, Germany. The full operator details are in the Imprint. In these Terms, "ONI", "we" and "us" mean the operator and "you" means the person using our services.
Last updated: 19 September 2026. Version 2026-09-19.
Some words have a fixed meaning in these Terms:
- A tournament (also called a Cup) is a competition we announce on the website or in Discord, with a schedule, a format and, where stated, prizes.
- A team is the group of players registered together for a tournament. The captain is the player who registered the team and speaks for it towards us.
- Staff are the people we appoint to run a tournament and moderate our services.
- The tournament rules are the rulebook published at /rules, made up of global rules and, where published, additions specific to a tournament that are shown after the global text of the section they belong to.
- "In writing" means text form (§ 126b BGB): an email, or a message in the team's chat with staff on the website. No signature is needed, from you or from us.
- Times and deadlines are in the Europe/Berlin time zone unless a tournament schedule says otherwise.
You accept these Terms when you register for a tournament or buy something in our store; both steps ask you to confirm this. When you register, we record which version of these Terms and of the tournament rules you accepted, and when. If you do not agree with these Terms, do not register and do not make a purchase.
The public pages of the website can be read without an account. The sections on content, availability and liability describe how we run the website for everyone who visits it.
2. Our services
ONIRust organises Rust tournaments. We operate the private tournament game server, the website used to register for and follow tournaments, a Discord community, and a store selling cosmetic digital ranks.
Taking part in a tournament is free. We charge no entry fee and no fee for claiming a prize. Prizes are governed by section 8.
Ranks are cosmetic only: a chat tag on the tournament server, a badge on the website and a role in our Discord. No purchase grants an advantage in a tournament, a place in one, or immunity from its rules, and a rank never affects admission, results or prizes.
Availability, maintenance and changes to our services are described in section 15.
3. Accounts
You sign in to the website with your Discord account and link your Steam account; we do not issue passwords of our own. You are responsible for keeping those accounts secure and for the activity you cause or allow through them. Tell us at [email protected] as soon as you notice that someone else is using your account.
One person, one account. You may register only yourself, only with a Steam account and a Discord account that belong to you, and only once per tournament.
You must not:
- Share your account with other users or play on someone else's account
- Access another user's account without permission
- Provide false or misleading information
- Attempt to bypass security systems, eligibility checks or bans
Discord and Steam are third-party services with their own terms, including minimum age requirements. You must meet them to use those accounts with our services.
We may restrict or terminate accounts that breach these Terms, as described in sections 7, 10 and 11.
4. Eligibility and admission to tournaments
Taking part in a tournament requires a Discord account and a Steam account linked on our website, membership of our Discord, and meeting the eligibility requirements published with each tournament (for example a minimum Rust playtime and a public Steam profile for as long as playtime is being checked). Every player completes their own checks; a team is admitted only once staff have approved it.
A player under 18 may take part only with the consent of a parent or legal guardian (§§ 107, 108 BGB). Tick the age box at registration only if you are 18 or older or that consent exists. We may ask the guardian to confirm the consent, at the latest before a prize is confirmed, and may keep the player out of the tournament until it is confirmed.
Places are limited. Registration does not give you a right to a place: teams that cannot be admitted may be kept on a backup list and admitted if a place opens. Before admission we may refuse a team or a player without giving reasons. After admission, removal follows section 7.
Eligibility checks that run automatically, such as the playtime check, only flag a registration; staff take the decision.
5. Tournament rules
The tournament rules form part of the contract between you and ONI for every tournament you register for, in the version published when you register together with changes announced under this section. They cover the format, scoring, fair play, recording (POV) requirements, enforcement, streaming and prizes.
If documents conflict, they apply in this order: these Terms; the rules published for the specific tournament; the global rules; announcements by staff in the tournament's Discord channels. Announcements that only apply the rules, such as a phase switch or a schedule change, are not a conflict.
While a tournament is running we change its rules only where fairness, a technical problem or a legal requirement demands it. Such a change is announced in the tournament's Discord announcement channel and on the website. It applies from the announcement onward, never to events before it.
We keep a copy of every published version of the tournament rules, including the sections specific to a tournament, and send you the version you accepted on request.
6. Fair play and duty to cooperate
You play fairly, follow the tournament rules and treat players and staff with respect. What counts as cheating, exploiting, teaming and point manipulation is defined in the tournament rules.
A tournament is played remotely, on your own machine, so we rely on you to help keep it fair. During a tournament you:
- Record your own gameplay as the tournament rules require and keep the footage until 14 days after the prizes of that tournament have been confirmed in writing
- Deliver requested footage unedited within 24 hours of the request, in the way the request describes: to the staff member who asked, by email or direct message and not in the team chat, unless staff say otherwise. Staff request footage when a case needs it or to verify a prize-winning result before prizes are confirmed
- Answer staff's questions about the tournament truthfully and completely
- Report bugs, exploits and rule breaches you notice instead of using or hiding them
- Read the tournament's Discord channels and the team chat on the website, which is where staff reach you
These duties apply to every member of a team. Failing to meet them is a breach of the rules in itself (section 7).
7. Investigations, sanctions and appeals
7.1 When staff act
Staff act under this section on the facts available to them. A reasonable, fact-based suspicion that a player or team has breached these Terms or the tournament rules is enough for the provisional measures in 7.3. A measure under 7.4 requires staff to be satisfied, on the facts available and after giving the player or team the chance to respond where the situation allows, that the breach more likely than not occurred. Certainty is not required; staff weigh the facts honestly and reach a conclusion a reasonable person in their position could reach.
The facts staff rely on include server logs, anti-cheat data, the kill feed and combat logs, POV footage, reports from players and staff, statistical analysis of gameplay, and public information about the accounts involved.
7.2 What we tell you
The notice tells you which rule you are found to have breached, the situation it concerns (when, where and what staff observed, in enough detail for you to respond to it) and the measure we take. We do not disclose our detection methods, raw anti-cheat data, the identity of anyone who reported you or other players' data. Disclosing them would show others how to avoid detection and would expose people who reported in good faith.
This does not limit your right of access under Art. 15 GDPR: on request we give you the personal data we hold about you, including log entries about your account. We may redact or withhold the parts that would reveal other people's data, such as who reported you, or our detection methods (Art. 15 (4) GDPR, § 29 (1) sentence 2 BDSG), and we tell you when we have done so.
7.3 Provisional measures
While a review is open, staff may freeze the points and prize entitlement of the players or team concerned, remove players from the server whitelist, hide or mark the affected results, and request POV footage. A provisional measure is not a finding that a rule has been breached; it keeps the situation open until staff have decided.
7.4 Measures
Depending on the seriousness of the breach, its effect on the result and whether it was repeated or hidden, staff may:
- Warn the player or team
- Deduct or correct points, including after the fact
- Void a raid, an objective or a round
- Remove the player or team from the current tournament
- Withhold a prize (section 8) or, where its confirmation was obtained by deceiving us, avoid the confirmation and demand the prize back (8.4)
- Exclude the player from future tournaments (7.8)
A team is responsible for each of its members. Results are achieved together and cannot be separated by player, so where one member cheats, plays on an unauthorised account, evades an exclusion, teams with another team or refuses to cooperate, the whole team may be removed from the current tournament. An exclusion from future tournaments (7.8) is personal: it applies to the player who committed the breach and to teammates who knew of it or must have known.
7.5 Not cooperating is a breach
Failing to cooperate under section 6 is a breach in itself. Not delivering requested POV footage within 24 hours, delivering edited or incomplete footage, giving untruthful answers or ignoring staff messages during a review may be sanctioned in the same way as the breach under review, unless the player shows that the failure was not their fault (§ 280 (1) BGB). A recording set-up that was never tested is the player's fault.
7.6 Public communication
Publicly we announce only the team or player concerned and the measure: that a team or player was removed from the tournament or that points were corrected under section 7, and not before we have sent the notice under 7.2. Until the appeal window has closed or the appeal is decided, the announcement is marked as under review, with a note that an appeal is possible within 48 hours. We name the rule concerned only once the decision is final, worded as our decision. We never publish evidence, details of the review or the names of people who reported.
If a measure is lifted or changed, we announce that in the same place and amend the original announcement. After the tournament you can ask us to replace your name in an archived announcement with a neutral label (see the Privacy Policy). You may say publicly that you disagree with a decision and give your own account of your case; what you may not publish is in 9.5.
7.7 Appeal and binding decision
You may appeal a measure in writing within 48 hours of the notice. Send the appeal by email to [email protected] with the subject line "Appeal – <team> – <tournament>", or post it in the team's chat with staff on the website; both count for the deadline. Say which Discord account and team you are, why you consider the decision wrong, and attach anything you rely on. The captain appeals for the team; a player sanctioned personally may appeal for themselves. A staff member who did not take the original decision reviews it. Provisional measures stay in place during the appeal. We answer in writing: during a live tournament as fast as the tournament allows and at the latest within 24 hours, otherwise within 14 days.
Once the appeal window has passed without an appeal, or once we have decided the appeal, the staff decision on whether a player or team has complied with the conditions of the tournament and of any prize is binding on all participants (§ 661 (2) BGB). Your rights under mandatory consumer law are unaffected; in particular, a court can still check that a decision was not arbitrary.
Nobody is entitled to compensation for time spent, in-game progress, resources, subscriptions, hardware or other expenses because of a measure under this section, including a provisional measure that is later lifted. This does not limit our liability under section 16.
7.8 Exclusion from future tournaments
Exclusion from future tournaments lasts until we lift it. We review every exclusion at the latest five years after it was made and delete it unless a specific reason to keep it is recorded. It applies to the person, not to an account: taking part under another account or through another team while excluded is ban evasion (section 11). We keep only the data needed to enforce the exclusion, as described in the Privacy Policy.
8. Prizes
8.1 Prize competitions
Where we announce prizes for a tournament, the announcement is a prize competition (§ 657 BGB and following). Its deadline is the published end time of the tournament (§ 661 (1) BGB). We announce a prize only together with that end time and with a reference to this section and to the Prizes section of the tournament rules, on the website and in the tournament's Discord announcement channel.
Registration, taking part, the standings, the live feed, statistics, messages from staff and a displayed prize pool create no entitlement to a prize. An entitlement arises only when we confirm the winner in writing, by email from [email protected], after the verification described in 8.4. Messages from staff in Discord, in voice or on stream, including congratulations, are not that confirmation.
8.2 Conditions of entitlement
A team is entitled to a prize only if all of the following are met:
- The team completed the tournament: it was neither removed nor withdrew before the end
- No breach of these Terms or the tournament rules that led to the team's removal, a disqualification or a points penalty affecting its prize-winning position has been found against the team or any of its members in connection with the tournament (section 7); a warning alone never excludes a prize
- All POV footage requested by staff was delivered
- The eligibility and identity of every team member have been confirmed, including the guardian's consent where a member is under 18 (section 4)
- The prize was claimed in time (8.5) with details we can lawfully use (8.11)
8.3 Published prize pools
A published prize pool states its conditions, for example a minimum number of teams, a scale by the number of participants, or items provided by a sponsor. Until the tournament ends we may change or withdraw a prize or a pool only for one of the following reasons, announced in the same way as the prize was announced (§ 658 BGB):
- The tournament is cancelled, shortened or restarted
- A technical failure of the server, the game or the scoring makes a result impossible
- Force majeure (section 15)
A prize is withdrawn only together with the cancellation of the tournament or of the part it belongs to. Where we change a prize, we provide one of at least equivalent value. A sponsor that fails to provide a promised prize is covered by 8.10.
After the tournament ends, we no longer change the prizes. What remains is our decision under section 7 on whether the conditions have been met.
8.4 Verification
Results shown on the website, in Discord and in streams are provisional until we confirm them in writing. After a tournament ends we verify the result: we review open reports, requested POV footage, logs and the eligibility of the teams concerned. Verification takes up to 30 days from the end of the tournament and is extended by up to 30 further days while an investigation or an appeal is open. We tell the captain in writing when verification is complete and which prize, if any, the team has won.
Where the conditions in 8.2 are met, we are obliged to confirm the prize within the verification period. If the verification period ends without a decision and no investigation or appeal is open, the provisional standings count as confirmed. Where a team's entitlement lapses under 8.2 or section 7, the prize goes to the team that follows in the corrected standings.
A confirmation obtained by deceiving us, for example by hiding a cheat or an unauthorised account, can be avoided within one year of our learning of it (§§ 123, 124 BGB); the prize is then returned (§ 812 BGB).
8.5 Payout and claim
Cash prizes are paid to the team captain. Payment to the captain discharges our obligation towards the whole team unless the team tells us a different split in writing before the payout. By joining a team, every member authorises the captain to receive the prize for the team. Where the captain or a member with a share is under 18, 8.8 applies to that part.
We pay by a method reasonably available in the winner's country, for example bank transfer or PayPal. We ask only for what the payment needs: the recipient's legal name, address and payment reference. We charge no fee for paying a prize; fees charged by the recipient's bank or payment provider are not ours.
A prize must be claimed within 60 days of the written confirmation by sending us the payout details or, for a physical prize, the shipping address. We send one reminder. A prize that is not claimed in time is treated as declined (8.9).
8.6 Physical prizes
Physical prizes are shipped only to countries we can lawfully and practically ship to. We use the shipping address only to ship this prize and share it only with the carrier, together with a phone number where the carrier needs one. Address and identity details are handled confidentially, with appropriate safeguards, kept for as long as tax law requires us to keep records of the prize (eight years, counted from the end of the calendar year in which the prize was fulfilled, § 147 (3), (4) AO) and then deleted (see the Privacy Policy).
If an announced item is unavailable we may substitute an item of equivalent value. Physical prizes are handed over as they are, with the manufacturer's warranty where one exists. We are liable for defects in a physical prize only for intent or gross negligence. This does not limit our liability under section 16, in particular for injury to life, body or health and under the Product Liability Act. The risk of loss or damage passes to the winner on delivery to the address given.
8.7 Taxes, fees and customs
Taxes, fees, customs duties and import charges on a prize are the winner's responsibility. We do not give tax advice. Where the law requires us to withhold or report something, we do so and tell the winner.
8.8 Minors
A prize won by a player under 18 is paid or shipped to the player's legal guardian, who claims it on the player's behalf. Where the captain is under 18, or a split notified under 8.5 allocates a share to a member under 18, that part is paid or shipped to the guardian. We may ask the guardian to confirm their identity and consent.
8.9 Unclaimed prizes
A prize that is not claimed within 60 days of the written confirmation, after one reminder, is treated as declined. The same applies where a prize cannot be paid or delivered because the details given are wrong and are not corrected within that period. Declined prizes stay with us or the sponsor and are not redistributed unless the announcement says so.
8.10 Sponsor prizes
Prizes provided by a sponsor are handed over as the sponsor supplies them. If a sponsor fails to provide a promised prize, we replace it with an item or an amount of equivalent value. We do not owe the specific sponsored item.
8.11 No alternative, and sanctions law
Physical prizes have no cash alternative and cash prizes have no physical alternative.
We pay or ship a prize only where doing so is lawful for us, in particular under European Union and German sanctions and export-control law. Before a payout we check the recipient's name against the consolidated list of persons subject to EU financial sanctions, because EU sanctions regulations forbid us to make funds available to a listed person; a confirmed match stops the payout and the result of the check is noted in the payout record. Where we cannot lawfully pay or ship to the winner, we offer an equivalent prize where that is lawful, or pay or ship to another eligible member of the team whom the team names in writing.
9. Recordings, content and licences
9.1 Our content
Our casts, streams, VODs, highlight clips and server-side recordings are produced by ONI; ONI holds the producer's rights in them (§§ 94, 95 UrhG) and the rights our casters grant us in their commentary. The website, the standings, statistics and live feed are ONI's website and database, and the ONIRust name and logo identify ONI. Rust itself, its graphics and sounds belong to Facepunch Studios Ltd; we record and publish gameplay within Facepunch's rules for game content. You may share and embed our publications as the platform they are published on allows, with credit to ONIRust. You may not sell them, present them as your own or use them to suggest that ONI endorses something.
9.2 Licence you grant us
By registering you grant ONI a non-exclusive, royalty-free, worldwide licence to use your in-game name, team name, team emblem, avatar, chat messages, in-game voice that a caster's or a spectator's game client picks up, and your gameplay as recorded on the server or in our casts, to run and document the tournaments you take part in for as long as we keep the tournament archive, and to promote ONI tournaments with material from those tournaments until you object: on the website, in Discord, in streams, VODs and highlight clips, in the standings and archive, on social media and in announcements of future tournaments. After an objection we make no new promotional use of your name, emblem, avatar or voice, while existing casts, VODs, standings and the archive remain.
The licence includes editing for length and format, combining the material with commentary, overlays and other teams' footage, and granting the platforms we publish on (for example YouTube, Twitch and Discord) the rights their terms require for that publication. We do not edit in a way that misrepresents what you did or said, and we do not use your name, voice or likeness to advertise the store or third parties. The licence does not entitle you to payment. How we handle the personal data involved, and how you object to a particular use, is described in the Privacy Policy.
Your team's Discord voice channel is not covered by this licence. Recording or broadcasting it needs the separate agreement of every member of that team; we ask for it per tournament, and it can be withdrawn at any time with effect for the future (Art. 6 (1) (a), Art. 7 (3) and Art. 8 GDPR).
9.3 POV footage
POV footage you submit to staff is used only to enforce the rules and to verify a prize-winning result. Only staff see it. We do not publish it and do not pass it to other players. We delete our copy of the footage and the link 90 days after the tournament ends or, where a dispute about that tournament is still open at that point, when the dispute is closed, unless the law requires us to keep it longer. A recording you uploaded to a video platform stays under your control; delete it there once that period has passed.
9.4 Team names, emblems and avatars
You warrant that you hold the rights to your team name, emblem and avatar, that they infringe nobody's rights and that they are not offensive, misleading or a copy of another team's identity. We may replace or remove a name, emblem or avatar that breaches this and ask you to choose another.
9.5 Your streams and publications
You may stream and publish your own gameplay from our tournaments, including your own voice. Streaming does not make you an ONI partner or imply our endorsement, and you may not present your stream as an official ONI cast without our written agreement.
You may not publish:
- Staff communications: the staff-team chat, tickets and direct messages from staff
- Material about other people from an open case: staff messages about them and what staff showed you about your own case while it is open
- Other players' private voice or Discord audio without their consent
- Accusations of cheating or rule breaches against a named player or team before staff have ruled
- Footage, logs or other material about other players that reached you through an investigation, for example from a teammate or as part of an appeal
Your own gameplay, streams and VODs are yours at all times. You may say publicly that you disagree with a decision and give your own account of your case (7.6), as long as you keep to the list above.
If we notify you that content breaches this section, you remove it within 48 hours. A breach is sanctioned under section 7 during a tournament and, after it, by exclusion from future tournaments under 7.8; for content on our own platforms, section 10 applies. We may remove content from our own platforms at any time.
10. Content on our platforms and moderation
On the website and on the game server you can post content: the team chat with staff, team names, emblems and avatars, and chat on the game server. We host that content; we do not check it before it appears and we do not monitor all of it. Content in our Discord, including messages and voice in Discord channels, is hosted by Discord Inc. under Discord's terms; in our Discord we moderate under these rules.
The following is not allowed on our platforms:
- Content that is illegal, including content that infringes copyright, trademarks or other rights
- Harassment, threats, hate speech, doxxing and the publication of other people's private information
- Sexual content involving minors, which we report to the authorities
- Spam, unsolicited advertising and links to malware or phishing
- Content that breaches section 9.5 or the conduct rules in the tournament rules
Where content breaches these rules or the law, we may remove or hide it, restrict a feature, and mute, kick or ban the account from Discord, the game server or the website. Where the law requires, we refer the matter to the authorities. Automated tools are used only against chat flooding and spam on the game server; every other decision is taken by a person.
Anyone can report content to [email protected], in English or German. Tell us where the content is (a link, or the channel and time), why you consider it illegal or against these Terms, your name and email address (you may stay anonymous when reporting sexual abuse material involving minors), and confirm that you believe your report is accurate and complete. We confirm receipt without undue delay, decide diligently and objectively, and tell you our decision and how you can contest it.
When we remove or hide content, restrict a feature or suspend or ban an account, we tell the affected user in writing: what we did and for how long; whether we acted on a report or on our own initiative; the facts we relied on; whether an automated tool was involved; the rule of these Terms or the provision of law that was breached; and that they can contest the decision by replying to [email protected] and may also go to court. We review the reply and answer. Deceptive high-volume commercial content (spam) is the exception: we remove it without a statement.
11. Prohibited conduct and sanctions outside tournaments
Across all our services the following is prohibited:
- Cheating or using unauthorized software
- Exploiting bugs or vulnerabilities
- Attempting to damage or disrupt our services
- DDoS attacks or threats
- Harassment or abuse of other players or staff
- Ban evasion
- Fraudulent payment activity
Outside a tournament we may issue warnings, mute, temporarily or permanently ban, or otherwise restrict an account that breaches these Terms, our Discord rules or the law. Sanctions in a tournament follow section 7; content moderation follows section 10.
Getting around a ban or an exclusion with another account, another person's account or a changed identity is ban evasion. Every account involved may be banned, and the exclusion may be extended (7.8).
Purchased ranks, perks or donations do not provide immunity from sanctions. A paid rank is ended without refund only for cheating, ban evasion, payment fraud or a serious breach after a warning (§ 314 BGB). For other bans the rank is suspended for the duration of the ban; a subscription may be cancelled by us for the next period. The Refund Policy says the same.
12. Purchases and payments
ONIRust may offer digital products such as ranks, perks, and other virtual benefits.
All purchases are made voluntarily by the user. The price shown at checkout is the total price you pay. Payments are processed by Stripe; we do not receive your full card or bank details.
Before completing a purchase, users are responsible for ensuring that:
- The correct account is being used
- The selected product is correct
- The provided information is accurate
How the contract is concluded: you choose a product on the website and are taken to Stripe Checkout, where you can check and correct your entries before you click the pay button; the contract is concluded when Stripe confirms your payment. We store the order data, and Stripe emails you the invoice or receipt for your records. The version of these Terms you accepted is available at /terms and from us on request. The contract language is English.
After successful payment, the digital product is delivered to the associated account.
13. Digital products
All products sold by ONIRust are digital products.
Virtual ranks, perks, and benefits:
- Have no real-world monetary value
- Cannot be exchanged for cash
- Cannot be transferred or sold to other users unless explicitly allowed
Purchasing a rank or perk does not grant ownership of any ONIRust assets or services. It is a licence to use a cosmetic feature on our services for the period shown at purchase: VIP as a monthly subscription, the other ranks for the term shown. Both are digital services provided over time (§ 327 (2) sentence 2 BGB), not one-off content.
Your statutory rights for digital products (§§ 327 and following BGB) remain unaffected: if a product is not delivered or does not work as described, contact us and we put it right.
14. Withdrawal and refunds
Taking part in a tournament is free and a prize is not a purchase, so the rules on withdrawal and refunds apply only to the store.
As a consumer you have a 14-day right to withdraw from a store purchase. How to exercise it, and a model withdrawal form, are in our Withdrawal Policy. For a subscription or a rank with a term the right of withdrawal does not end early. If you ask us at checkout to activate the rank immediately and withdraw within 14 days, you pay a proportional amount only for the days already provided (§ 357a (2) BGB) and get the rest back. Only for a genuinely one-off digital deliverable, if we ever sell one, does the right end when delivery starts, and only where you expressly agreed to immediate delivery at checkout and acknowledged losing the right (§ 356 (5) BGB).
Refunds for digital products are handled according to our Refund Policy.
15. Availability, changes and cancellation
We aim to provide reliable services but cannot guarantee uninterrupted availability. We may modify or update our services, perform maintenance, change features or availability, and temporarily or permanently discontinue services. For paid digital products, your rights under sections 13 and 19 apply.
We may reschedule, pause, shorten, restart or cancel a tournament where the game, the server or the integrity of the competition requires it. We announce this in the tournament's Discord channels and on the website. What happens to the prizes is described in 8.3.
We are not responsible for delays or failures caused by events outside our reasonable control (force majeure), in particular game updates or patches by Facepunch that break the server or its plugins, DDoS attacks, outages at our hosting, network or payment providers, Steam or Discord outages, power or connectivity failures, legal orders and natural events.
16. Liability
We are liable without limit for damage we cause intentionally or by gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz).
For slight negligence we are liable only where we breach an essential contractual duty, that is a duty whose fulfilment makes the proper performance of the contract possible in the first place and on which you regularly rely. In that case our liability is limited to the damage that is typical for this kind of contract and was foreseeable when the contract was made.
For services we provide free of charge, in particular tournaments and prize competitions, the Discord community and the website, we are liable only for intent and gross negligence. The unlimited liability for injury to life, body or health and under the Product Liability Act applies here too.
These limits also apply in favour of our staff, helpers and agents.
If a third party brings a claim against us because of something you are responsible for, for example content you posted, a team name or emblem that infringes their rights, or damage you caused on the server, you indemnify us against that claim, including reasonable legal costs, to the extent you are responsible for it. We tell you about the claim promptly and do not settle it without hearing you.
17. Third-party services
Rust, Steam and Discord are provided by Facepunch Studios Ltd, Valve Corporation and Discord Inc. under their own terms. We do not control them and are not responsible for their availability, their changes or their decisions. ONIRust is not endorsed by or affiliated with Facepunch Studios Ltd, Valve Corporation or Discord Inc.
A ban by Easy Anti-Cheat, a Steam game ban or VAC ban, or a Discord ban is outside our control; we cannot lift or review it. The eligibility rules published with each tournament say whether, and for how long, a game ban or VAC ban on an account excludes it from taking part. A game ban received during a tournament, or shortly after it, is a reasonable ground for measures under section 7.
We comply with European Union and German sanctions and export-control law. We may refuse or end a service where providing it would be unlawful for us. Prizes are covered by 8.11.
18. Data protection
How we process personal data for accounts, registration, eligibility checks, gameplay logs, investigations, the publication of results, prizes and the store, how long we keep it and which rights you have is explained in our Privacy Policy.
Gameplay on the tournament server is logged and may be shown publicly on the website as standings, statistics and a feed of in-game events under your Steam and Discord display names.
19. Changes to these Terms
The tournament rules bind you per tournament, in the version you accepted when you registered together with changes announced under section 5. A new tournament may come with updated rules; you accept them when you register for it.
We change these Terms where we have a good reason: a change in the law or in how courts read it, a change in our services or providers, or to close a gap or remove an ambiguity. We announce a change on the website and in Discord at least 14 days before it takes effect, together with the new version and a summary of what changed. If you do not agree with a change, you may object to it before it takes effect and stop using the affected services; we may then end the affected free services with you. A paid product you already bought continues under the version you accepted. Where a change to a paid digital product affects your access to it or its usability more than insignificantly, you may end the contract free of charge within 30 days of being told about the change (§ 327r BGB).
The version date at the top of these Terms shows the current version. Earlier versions are available from us on request.
20. Final provisions
These Terms and every contract under them are governed by the law of the Federal Republic of Germany. If you are a consumer and live in another country, the mandatory consumer-protection rules of that country still apply to you where they are more favourable (Art. 6 (2) Rome I Regulation).
We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board (§ 36 VSBG).
If one clause of these Terms is or becomes invalid, the rest of the Terms remains in force. In place of the invalid clause, the statutory rules apply (§ 306 BGB).
These Terms are written in English. If we publish a translation, the English version governs.
